thanks to our panel for being here. next week we will talk how to get power out of the hands of the washington elite and back into the hands of the people. join us nexhappy halloween. rick leventhal is next with the "fox report". >> the federal grand jury of purely approves the first charges in russian alleged meddling. i'm rick leventhal and this is the "fox report". after months of working in the shadows special counsel robert muller may be about to put his cards on the table as the white house braces for the possible unsealing of an indictment on monday. all of this is sparking widespread speculation on who could be targeted. lawmakers say they are being kept in the dark.

>> let's assume the reporting is true and we do not know who is being charged for what they are being charged for. we do not know the time period. i will tell you this. the only conversation i had with robert muller was stressing to him the importance of cutting out the leaks with respect to serious investigation. it is ironic that the people charged with investigating the law and executing the law would violate the law and make no mistake disclosing grand jury material is a violation of the law. rick: we go to garrett in washington. anymore idea of what we can expect to play out tomorrow? >> there are a number of scenarios we can see. wall street journal and others are saying arrest could be made as soon as tomorrow. what would typically happen next is that person or persons would be brought before a judge for an initial hearing with charges against him are laid out and found is that. in white-collar cases such as this bill is typically posted right away and the person is free to go until the next

hearing. i think typically because there is a lot that is not typical about this investigation this afternoon former attorney general said the fact that someone is being arrested at all here could be an indication that the special counsel's team plans to play hardball going forward. >> usually in white-collar cases there is an arrangement with a lawyer for the defendant and the defendant to show up at the courthouse, be advised of the charges and enter a plea which is usually not guilty and have built a set but if they're going to make an arrest and instead of simply having someone show up that is pretty harsh. rick: the two names we've heard the most in this investigation are former trump campaign and national security adviser michael flynn. it is entirely possible that the person being charged is someone we have never heard of. whatever may be the case who is being charged with what will likely shed light on where the investigation into russia's election meddling stands and it has moved on the allegation that

the president can be included with russia. >> robert mueller is back in the spotlight. >> going back to the summer when robert mueller began to put his team together a number of republican lawmakers expressed concerns that some of the people he was bringing on board were too political for this investigation and others have said muller should step down to recuse himself because of the james comey. there is still strong support for muller on capitol hill but without knowing the details of these new charges we started hearing some of those concerns again. >> i do not know where he is going. it brings question to mind especially he hired at the very beginning. a lot of individuals and attorneys who played in politics and have given money on the democratic side. >> i readily concede i'm in a loosely small group of republicans and i think bob muller has a distinguished career of service to our country and the result will be known by the facts and by what he uncovers. the personalities involved are less important to me than the underlying facts. i would say give the guy a chance to do his job.

>> that is one more story line as charges come out of the next couple of days and if this calls for him to step down do go away or if they get nude hundred renewed life here. rick: garrett, thanks very much. president trump reclaiming republicans are united in their tech support. despite two senators would disavow the president over his behavior. the public feud raising questions on whether the party will move to embrace the parties brand of populism in 2018. ohio governor john kasich saying he has his doubts. >> i think this move toward nationalism and looking inward is a lot of loud voices but i don't think it is the ball. we will have to see overtime. rick: for more on this we go to christian fisher at the white house. any more republican lawmakers attacking the president? >> not really. even senator corker really seem

to dial it back and almost every republican senator was on the sunday shows some version of do you share senator corker's and senator blake's concerns that perhaps this president is a danger to our democracy and hurting the party and every one of them stood by this president. >> president trump was elected and duly elected and including those in ohio and we want him to succeed because then the country succeeds. i not voted for him in the butt when he was elected i said i would work with him. >> first, let me say that jeff flake is one of my best friends in the senate and i have enormous respect for him and i am sorry that he is not going to be running for reelection. having said that i think we need to accept that donald trump is our president.

reporter: one of the more memorable lines was when he asked his colleagues what will we tell our next generation when they asked why didn't you speak up and what will be say. governor john kasich was asked that question pointblank on "fox news sunday" and here is what he said: >> i have spoken up more than anybody. mine is not personal. mine is policy. reporter: so far this call by senator flake to resist this president continues. we met with silence from other republicans on capitol hill. rick . rick: i got a peek at president trump schedule and he is a busy

week ahead. reporter: very busy week ahead. the overriding post will be his top legislative priority, text, that will be a big one. president trump is also expected to announce his pick to the next chairman of the federal reserve and on top of all of that he is going to be preparing for his big 12 day trip to asia and you've got stops plant in china, japan, vietnam, philippines and south korea, all countries that are growing increasingly concerned about this nuclear threat coming from north korea. one of the big outstanding questions continues to be is president trump going to visit the dmz, the demilitarized zone right on the border between north and south korea and if the white house has made a decision one way or another so far they are not making that public but if he decides to go, rick, what a moment that would be. rick: we may have more insight on that in a moment. president dry staying dry in on a rainy night in washington. reporter: i'm trying. rick: nice work. if you follow the president on

twitter you probably saw he lit it up this morning. trumps attorney says the early morning tweets are unrelated to robert mueller. the president tweeted among other things: he also wrote: let's bring in judith muller, adjunct professor. not nearly as active as the president on twitter. >> i couldn't possibly keep up, rick. rick: you just got back from south korea and you are shaking your head when kristin was talking about the possibility that the president would go to the dmv and you are saying that is not happening. >> when i left south korea, at the time, the american officials and people who watch this closely said he will not go to the dmz. he will go to camp humphreys where we are moving a lot of our forces and this will be a forward-looking trip not a backward looking trip but that could change.

as you saw, president trump himself said keep watching and you will be surprised. rick: asked for his teeth this morning he is clearly not the only person concerned that hillary clinton and the dmz funded that dossier that led to the investigation and grand jury suggesting that this force may be tainted and that the information might be tainted that led to this whole probe. >> i find it hard to believe that someone as experienced as robert mueller would actually use or issue any piece of paper with an official stamp on it that was based on information in a dossier that had not been verified and the origins of which he did not know. that doesn't sound like a very, careful, cautious robert mueller reno. rick: we heard plenty of the public and lawmakers say that information is false and much of it they've determined is not true. >> that's right and in which case one has to assume there were other reasons for issuing the subpoenas and asking for the information that he did be six your opinion is not that comey

might not and that mueller might not be the best, impartial person because of his friendship with call me) with the clintons. you do not believe he cannot be partial. >> i believe he is impartial as one can possibly be in this matter. i think the president and republicans are very eager to change the subject. i would want a distraction, too. i would want to talk about the tax bill and i would want to talk about my agenda and i would want to talk about hillary clinton that something that happened seven years ago. rather than the issue at hand and the issue we have been worried about since there were rumors and reports first surfaced which is did the russian try and influence our election and if so, how did they try and do they succeed and is there any collusion on the part of republicans or democrats with them. this is what we want to know and what the country wants to know. rick: and it's something we still do not know. >> we do not even know who will be indicted or if there is going

to be someone indicted tomorrow. rick: or if they are indicted for something completely different or unrelated to any russian collusion. it could be tax fraud or -- >> it could be tax fraud, we know that paul manafort who was very briefly was the campaign manager for mr. trump and we know that robert mueller has been investigating his very complex financial dealings and his relationship with the russians. i spent a lot of time in ukraine and it was well known in ukraine that mr. manafort was working with ukrainians who were pro- russians. rick: paul manafort was one of the names along with michael flynn one of the names being thrown around that might be indicted tomorrow and you have no information -- >> i have no information and unless i had it confirmed by two or three sources and the t's crossed and the eyes darted i would not venture anything on the air. all of this speculation really isn't helpful. at this point, let's watch this investigation unravel and see what happens. we need our analytical skills to analyze what is happening and not pick the future. if i had a ouija board i would tell you i don't.

rick: tonight we marking anniversary many of the authorities would rather not remember. five years ago today super storm sandy devastated the region. it swallowed beaches and surging inland. swapping communities that do not normally flood. it damaged hundreds of thousands of homes and ultimately telling at least $65 billion in damages. new york governor andrew cuomo reported on the impact of the storm. >> we learn that homes built on a wetland and a floodplain they are on a temporary lease and the land is owned by mother nature and she will come back and reclaim it in those homes are going to be gone. we learn to build with resiliency and put homes on peers and buildings on peers and we learn to set up fuel reserves and we learned to have backup generators where we need them. rick: in new jersey, sandy's

not seen any circulation there but nonetheless, still a tropical storm that at this point is moving at 60 miles an hour and even with that it will not be the last storm that we see. it will not make landfall but will have an impact on the us weather here for the next couple of days. rick: i marty hearing flooding warnings in new york city but also the problems in new england. >> yeah, it's connected with the system. i said it will not make landfall in that is the case but it is running right into a cold front and it is feeding all that moisture so along that frontal boundary to the mid atlantic to new york city and into new england and all areas where we are seeing very heavy rain and it will continue and this moisture will continue to live from dc tomb of philadelphia and farther north and this will be

slow moving. in the next 12 or 18 hours we will see this move through but it is a consistent heavy rain and we are talking about additional to what we've already seen philadelphia running up further to the north and you're looking at perhaps another four-5 inches and when you talk about four or 5 inches in that short amount of time no spicier we have flood warnings in the flood watch is stretching across all of the mid-atlantic into new england and that's all along the boundary and that's what were watching now all the way until about lunchtime tomorrow. rick: and you do not want to see the yellow and orange and red. thanks, adam. meanwhile puerto rico and the electric company is canceling a no-bid contract to repair its electric grid. the $300 million signed with the montana based company with ties to the interior secretary, ryan zinke but was quickly criticized by federal officials skeptical of that company's ability to deal with this catastrophic damage. this is more than 80% of puerto ricans without power in some five weeks after hurricane maria

accident which is under investigation. bloodshed in mogadishu after a terror attack on a hotel in somalia's capital. security forces have not restored order after gunmen stormed a hotel saturday night killing at least 23 people during the overnight siege. authorities is a three attackers were killed and two others captured. the islamic terror group al-shabaab is claiming responsibly. this is the second tier tech this month in the city. two weeks ago a massive truck bomb killed 350 people in somalia's where the tax ever. in spain, political turmoil is mounting as people march for unity in barcelona two days after catalonia declares its independence. the spanish government response by seizing control of the region. connor powell is in jerusalem with the story. reporter: 48 hours after catalog politicians declared independence from madrid, hundreds of thousands of people took to the streets in barcelona to protest the move. declared support for unified spain. >> no one speaks for us. we are catalonian's. we want a vote. reporter: spain's central government has called for an election on december 201st and recently catalonia's autonomy government and post officially show a majority, albeit a small majority in the region, want to stay a part of spain. a vocal minority has pushed for independence. emotions are running high and the possibility for violence remains real. spanish authorities are scheduled to take over control, catalonia's government this week and it's a move that could inflame the situation more. the us and the eu are urging the two sides to compromise and to open a dialogue. so far, that has been avoided. rick. rick: connor in the drizzle.

rick: i'm rick leventhal and this is the fox. it's a busy weekend for president trump as he prepares to announce his pick of the next chairman of the federal reserve. the president also gearing up for a 12 day trip to asia. he leaves for that on friday. washington is bracing for the first charges on robert mueller's investigation. "the wall street journal" reporting that indictment could be opened as early as monday. the washington three begin now saying it initially pay for the opposition research done by fusion gps on republican candidates in 2016 campaign however, it says it had nothing to do with the former british spy who compiled the now infamous drop dossier that was funded by the dnc and the clinton campaign. house oversight trey gowdy said

lawmakers have to get to the bottom of this. >> i am interested in who paid for the dossier because that helps you understand motive and intent and whether or not you can rely on the document. i am much more interested in whether the department of justice and the fbi relied on that dossier in initiating a counterintelligence investigation or in court filings. rick: for more on the firelight of this controversy we go to caroline in washington. reporter: president trump said democrats should stop looking at him over the dossier that claims his campaign had ties to russia and focus on the fact that the clinton campaign helped to pay for it. the president tweeted in part they look at only trump russian collusion which doesn't exist. they are using terrible witchhunt for evil politics. the dossier claims the russian government helped mr. trump campaign win and try to gather dirt on him for potential blackmail. it was put together by former british to buy, christopher

steele. he shared some of his findings the fbi around the same time the bureau launched its investigation. part of it is unsubstantiated rumor but other parts echo an assessment by us intelligence agencies that says russia intervened in the election. >> they relied on the dossier and they didn't cooperate it, or that it, then we have a serious issue and that is the next thing that house intel is trying to find out is whether the us government relied on. reporter: firm behind the dossier, fusion gps, was paid more than a million dollars from a law for working with the clinton campaign and the democratic committee. there is a more important question than wrote the check. >> how much of the work is accurate? how much is true? my colleagues did not seem particularly interested in the question but that is the most important question for the american people. reporter: susan collins said that representatives from the dnc and the clinton campaign

video were the ones that said i will never watch an nfl game and i was the one is a former nfl player to say let's hold on a second and we had conversations and ultimately in lettuce to making the dear flag video. rick: i met a couple of the guys i met you in dallas in that event and these are great people who lost limbs or suffer catastrophic injuries and they are getting pretty special attention and as we can see in the videos here. >> when president bush and speaker ryan came to visit our gym earlier this summer bush looked at them and said look, your greatest opportunity as a leader is in front of you and i believe that. this is the type statement. it doesn't matter who goes first in the situation because we can't move forward without each other. i believe great leadership is about doing what you can where you are with house and that is what these veterans and billions from the adaptive training foundation have done. rick: and they pose specific challenges for you as a trainer because of their missing lives. >> true. yeah, it impossible is only an opinion and they embody what it means to have the human spirit.

we are quick to marginalize our own capabilities and when i hear people say my vote doesn't matter but i believe that and this dear flag movement and what we have been flooded with on the dear flag .com website is people's e-mail saying i would never have thought i would be writing this but i'm writing this to you saying that somehow your video changed something for me. i will still stand or i will still kneel but that's okay but how do we create a narrative or how sleep that there is a conversation to be have out of kindness and respect. rick: the theme of that audio is basically what the flag stands for is what enables people to kneel and others to stand and it's the rights that we have that are so important. >> yeah, i think all men are created equal. our constitution says that. if you believe in freedom, justice and equality we have to be quick to be able to say this is what i stand for in this is what you stand for and let's figure out a way those intersect

because where they do that is where this country is all about and that's why people from different countries want to come here and this is the american dream. in this current state and climates that is so volatile that people can't see through that so the only way to create a perspective is to look to people like this and at some level it's been marginalize any been treated less than and in this case is for ballplayers sometimes they are treated as a commodity or as something that is expendable and we have to look at our deep words as human beings and that is what our constitution stands for and that is why i'm here to fight for the social injustice and for that flag. rick: when you play for the rams in the seahawks, players were not kneeling during the national anthem. i wonder what you would have done. >> again, there is a part of this team atmosphere in solidarity that matters and when you go to sweat and bleed for
